If your vehicle is worth more than the statutory automobile exemption,  there are other State exemptions that allow you to retain your vehicle;  your attorney will be able to help you with this.&lt;/span&gt;&lt;/p&gt; &lt;p&gt;&lt;span style="font-family:Calibri;font-size:100%;"&gt;If you are making payments on your  vehicle, you have three choices.  First, you may surrender the  vehicle.  If you choose to surrender the vehicle you will be forgiven  of any deficiency on the loan, the amount of the loan less the amount  the vehicle was sold at auction.   Second, you may redeem  your car by paying the lender in full.   The Third choice  is you reaffirm the loan, basically enter into a new contract with your  lender and keep the same terms of the original agreement.    If you choose to reaffirm your loan you may negotiate with the lender  for a better interest rate or reduced payoff, if the payoff is more  than the value of your vehicle.   You have a bargaining chip  in the negotiations because the lender knows that you have the right  to surrender the vehicle and they can either choose to have used inventory  or a regular monthly payment.&lt;/span&gt;&lt;/p&gt; &lt;p&gt;&lt;span style="font-family:Calibri;font-size:100%;"&gt;It is important to realize that if  you choose to reaffirm your automobile loan and later are unable to  make the payments, the lender will have the right to reposses the vehicle,  sell it at auction and begin the collection of the deficiency amount  from you.  The lender may obtain a court judgment. Now I have heard that I will have to pay income taxes on the amount I was forgiven in the sale. I already owe income taxes from 2002 and 2003. I have heard that a bankruptcy will eliminate my tax debts. Is this true?&lt;/span&gt;&lt;br /&gt;&lt;br /&gt;&lt;span style="font-family:times new roman;"&gt;Dear Blogger:&lt;/span&gt;&lt;br /&gt;&lt;span style="font-family:times new roman;"&gt;&lt;br /&gt;Bankruptcy may help eliminate or restructure your debt, depending on which Chapter you qualify for, however, only some taxes can be eliminated in bankruptcy. You may hear radio commercials offering the hope of eliminating tax debts in bankruptcy. But it's not as simple as it sounds. Most tax debts can't be wiped out in bankruptcy – you'll continue to owe them at the end of a Chapter 7 bankruptcy case, or you'll have to repay them in full in a Chapter 13 bankruptcy repayment plan.&lt;/span&gt;&lt;br /&gt;&lt;br /&gt;&lt;span style="font-family:times new roman;"&gt;If all of the following conditions are true and you qualify to file a Chapter 13 bankruptcy your tax debts will be paid at the same rate as your credit card debts through your Chapter 13 plan and after the successful completion of your plan, your tax debt will be eliminated; if all of the following conditions are true and you qualify to file a Chapter 7 bankruptcy your tax debts will be eliminated:&lt;/span&gt;&lt;br /&gt;&lt;br /&gt;&lt;span style="font-family:times new roman;"&gt;    * &lt;span style="font-weight: bold;"&gt;The taxes are income taxes&lt;/span&gt; - payroll taxes or fraud penalties, can never be eliminated in bankruptcy.&lt;/span&gt;&lt;br /&gt;&lt;span style="font-family:times new roman;"&gt; &lt;br /&gt;* &lt;span style="font-weight: bold;"&gt;You did not commit fraud or willful evasion&lt;/span&gt; – you commit fraud when you file a fraudulent tax return or willfully attempt to evade paying taxes, one example is using a false Social Security number on your tax return. Bankruptcy can't help.&lt;/span&gt;&lt;br /&gt;&lt;span style="font-family:times new roman;"&gt; &lt;br /&gt;* &lt;span style="font-weight: bold;"&gt;The debt is at least three years old&lt;/span&gt;. - Your tax return must have been originally due at least three years before you file for bankruptcy. Did you file an extension to file your tax returns? Then you must calculate the three years from the extension due date.&lt;/span&gt;&lt;br /&gt;&lt;span style="font-family:times new roman;"&gt; &lt;br /&gt;* &lt;span style="font-weight: bold;"&gt;You filed a tax return.&lt;/span&gt; You must have filed a tax return, for the year of the tax debt you want to eliminate, at least two years before filing for bankruptcy.&lt;/span&gt;&lt;br /&gt;&lt;span style="font-family:times new roman;"&gt; &lt;br /&gt;* &lt;span style="font-weight: bold;"&gt;You pass the "240-day rule."&lt;/span&gt; The income tax debt must have been assessed by the IRS at least 240 days before you file your bankruptcy petition, or must not have been assessed yet.&lt;/span&gt;&lt;br /&gt;&lt;span style="font-family:times new roman;"&gt; &lt;br /&gt;* &lt;span style="font-weight: bold;"&gt;All of these time limits may be extended by an “offer in compromise” or a previous bankruptcy.&lt;/span&gt;&lt;/span&gt;&lt;br /&gt;&lt;br /&gt;&lt;span style="font-weight: bold;font-family:times new roman;" &gt;One more thing – did the IRS record a tax lien in the county where you live in within the last 10 years?&lt;/span&gt;&lt;br /&gt;&lt;span style="font-family:times new roman;"&gt;&lt;br /&gt;Do you want the good news or the bad news first? Well, so we can end this blog on a positive note I will give you the bad news first. If the IRS recorded a tax lien in the county you live or own property within the last 10 years, you’ll have to pay off the tax lien in order to sell the property. The good news is that as long as the tax debt passes the 3 year, 2 year and 240 day rule your bankruptcy will eliminate your personal obligation to pay the debt which prevents the IRS from going after your bank account or wages.&lt;/span&gt;&lt;br /&gt;&lt;span style="font-family:times new roman;"&gt;&lt;br /&gt;The rest of the good news is that if you must pay your income taxes because they do not qualify for forgiveness under the 3 year, 2 year and 240 day rule; and you qualify for a Chapter 13, you know exactly how much you must pay off during your bankruptcy because the amount of the debt is frozen on the date you file your bankruptcy. As long as you successfully complete your Chapter 13 plan, you are free from that tax debt.&lt;/span&gt;&lt;br /&gt;&lt;span style="font-family:times new roman;"&gt;&lt;br /&gt;Each bankruptcy is an individual case. Your circumstances may be similar to others filing for bankruptcy, however, the totality of your circumstances make your case different from anyone else’s. The factors determining whether it will be forgiven are (1) what tax year the debt was incurred, (2) the date the tax return was filed and (3) whether the tax has been assessed. If our blogger qualifies for and files a Chapter 7, the tax debt will survive the bankruptcy. This nation’s worst downturn in 70 years pushed more formerly affluent people into bankruptcy than in previous recessions. Overall, &lt;/span&gt;&lt;span style="font-size:100%;"&gt;&lt;a href="http://www.stonehavenlaw.com/"&gt;&lt;span style=""&gt;personal bankruptcy filings&lt;/span&gt;&lt;/a&gt;&lt;/span&gt;&lt;span style="font-size:100%;"&gt; were up 36.5 percent in the first half of 2009 from the same time a year ago, and experts predict the number of filings will keep rising even as the economy recovers. &lt;a name="_ftnref"&gt;&lt;/a&gt;We are finding more and more of our clients had annual income of $60,000 or more, were careful with their money and through no fault of their own are simply unable to make their payments. Leslie Linfield, executive director of the Institute for financial Literacy, calls it “a middle-class recession”&lt;o:p&gt;&lt;/o:p&gt;&lt;/span&gt;&lt;/p&gt;  &lt;p class="MsoNormal"  style="text-align: justify; line-height: normal;font-family:arial;"&gt;&lt;span style="font-size:100%;"&gt;&lt;o:p&gt; &lt;/o:p&gt;&lt;/span&gt;&lt;/p&gt;  &lt;p class="MsoNormal"  style="text-align: justify; line-height: normal;font-family:arial;"&gt;&lt;span style="font-size:100%;"&gt;Our blogger needs to find out what remedies are available through bankruptcy. The remedies of Chapter 7 and Chapter 13 are different. First, what type of Bankruptcy does our blogger qualify for? If our blogger &lt;/span&gt;&lt;span style="font-size:100%;"&gt;&lt;a href="http://stonehavenlaw.com/CHAPTER7_BANKRUPTCY.html"&gt;&lt;span style=""&gt;qualifies for a Chapter 7&lt;/span&gt;&lt;/a&gt;&lt;/span&gt;&lt;span style="font-size:100%;"&gt;, but needs the remedies of a Chapter 13, then our bloggers’ Chapter 13 can be for as few as three (3) years or as long as (5) years, depending on the debts our blogger &lt;b&gt;must&lt;/b&gt; pay (in a Chapter 13, priority and secured debts must be paid, the unsecured creditors receive a percentage payment on the amount they are owed) and how much “disposable income” our blogger has. We know our blogger has tax debt. This &lt;b&gt;must&lt;/b&gt; be paid in full through a Chapter 13 plan and is a determining factor in the minimum amount the Chapter 13 monthly plan payment will be.&lt;o:p&gt;&lt;/o:p&gt;&lt;/span&gt;&lt;/p&gt;  &lt;p class="MsoNormal"  style="text-align: justify; line-height: normal;font-family:arial;"&gt;&lt;span style="font-size:100%;"&gt;&lt;o:p&gt; &lt;/o:p&gt;&lt;/span&gt;&lt;/p&gt;  &lt;p class="MsoNormal"  style="text-align: justify; line-height: normal;font-family:arial;"&gt;&lt;span style="font-size:100%;"&gt;The changes in the Bankruptcy Code added a three (3) part test to determine if our blogger qualifies for a Chapter 7 (liquidating) &lt;/span&gt;&lt;span style="font-size:100%;"&gt;&lt;a href="http://stonehavenlaw.com/CHAPTER13_BANKRUPTCY.html"&gt;&lt;span style=""&gt;Bankruptcy or Chapter 13&lt;/span&gt;&lt;/a&gt;&lt;/span&gt;&lt;span style="font-size:100%;"&gt; (repayment plan) Bankruptcy. The first and second parts of the test are based on our bloggers last six months of income from all sources, multiplied by two, to determine our bloggers “annual income”. The third part of the test is based on our bloggers current income and expenses.&lt;o:p&gt;&lt;/o:p&gt;&lt;/span&gt;&lt;/p&gt;  &lt;p class="MsoNormal"  style="text-align: justify; line-height: normal;font-family:arial;"&gt;&lt;span style="font-size:100%;"&gt;&lt;o:p&gt; &lt;/o:p&gt;&lt;/span&gt;&lt;/p&gt;  &lt;p class="MsoNormal"  style="text-align: justify; line-height: normal;font-family:arial;"&gt;&lt;span style="font-size:100%;"&gt;Part One compares our bloggers “annual income” and household size with the local standards of “median income level” for the same size household. If our bloggers annual income exceeds the “median level income”, then our blogger qualifies for a Chapter 13.&lt;o:p&gt;&lt;/o:p&gt;&lt;/span&gt;&lt;/p&gt;  &lt;p class="MsoNormal"  style="text-align: justify; line-height: normal;font-family:arial;"&gt;&lt;span style="font-size:100%;"&gt;Part Two subtracts our bloggers secured monthly payments (i.e. monthly mortgage or auto payment), allowable necessary expenses (IRS standards based on household size), and mandatory tax and insurance deductions from our bloggers monthly income (“annual income” divided by the number of months in a year). If there is no “disposable income” remaining after these expenses are deducted, then our blogger qualifies for a &lt;/span&gt;&lt;span style="font-size:100%;"&gt;&lt;a href="http://stonehavenlaw.com/CHAPTER7_BANKRUPTCY.html"&gt;&lt;span style=""&gt;Chapter 7&lt;/span&gt;&lt;/a&gt;&lt;/span&gt;&lt;span style="font-size:100%;"&gt; and can also elect a three (3) year &lt;/span&gt;&lt;span style="font-size:100%;"&gt;&lt;a href="http://stonehavenlaw.com/CHAPTER13_BANKRUPTCY.html"&gt;&lt;span style=""&gt;Chapter 13&lt;/span&gt;&lt;/a&gt;&lt;/span&gt;&lt;span style="font-size:100%;"&gt;.&lt;o:p&gt;&lt;/o:p&gt;&lt;/span&gt;&lt;/p&gt;  &lt;p class="MsoNormal"  style="text-align: justify; line-height: normal;font-family:arial;"&gt;&lt;span style="font-size:100%;"&gt;&lt;o:p&gt; &lt;/o:p&gt;&lt;/span&gt;&lt;/p&gt;  &lt;p class="MsoNormal"  style="text-align: justify; line-height: normal;font-family:arial;"&gt;&lt;span style="font-size:100%;"&gt;The third and last part of the test looks to our bloggers current monthly income and expenses. After subtracting expenses from income, if there is “disposable income” which when multiplied by 60 would pay 25% of our bloggers total unsecured debt, our blogger qualifies for a Chapter 13.&lt;o:p&gt;&lt;/o:p&gt;&lt;/span&gt;&lt;/p&gt;  &lt;p class="MsoNormal"  style="text-align: justify; line-height: normal;font-family:arial;"&gt;&lt;span style="font-size:100%;"&gt;&lt;o:p&gt; &lt;/o:p&gt;&lt;/span&gt;&lt;/p&gt;  &lt;p class="MsoNormal"  style="text-align: justify; line-height: normal;font-family:arial;"&gt;&lt;span style="font-size:100%;"&gt;Sounds complicated? The changes in the Bankruptcy Code made it more difficult for the honest debtor to seek relief, but not impossible.&lt;o:p&gt;&lt;/o:p&gt;&lt;/span&gt;&lt;/p&gt;  &lt;p class="MsoNormal"  style="text-align: justify; Ford Federal Direct Loan Program (“Direct Loan”), of­fers various repayment options for student loan debtors. One of these is the Income Contingent Repayment Plan (the “ICR” plan). This includes a foreclosure proceeding.  To this end, bankruptcy is an intriguing option to many homeowners facing foreclosure, as a mechanism to stop the home foreclosure and eliminate or reorganize their other debts.  The most common and important question we are asked is how long the foreclosure process is stopped for.  The answer to this depends on the particular chapter of bankruptcy a debtor will be filing for.&lt;br /&gt;&lt;br /&gt;A &lt;a href="http://www.stonehavenlaw.com/BANKRUPTCY-chp7.html"&gt;Chapter 7 bankruptcy&lt;/a&gt;, also referred to as "liquidation," completely eliminates all of a debtor's legal liability to pay unsecured debt. Unsecured debt includes debt from credit cards, medical bills, and unsecured personal loans.  If a Chapter 7 debtor is facing foreclosure, the bankruptcy will temporarily halt the foreclosure process until one of the following occurs: the bankruptcy process is completed, or the foreclosing lender gets the judge to lift the automatic stay. A &lt;a href="http://www.stonehavenlaw.com/BANKRUPTCY-chp13.html"&gt;Chapter 13 bankruptcy&lt;/a&gt; consolidates debt and reorganizes it into an affordable monthly payment plan approved by the court. In comparison to Chapter 7 bankruptcy, Chapter 13 does not completely eliminate a debtor's unsecured debt and requires a debtor to repay a portion of or all of the debt. However, the debtor is able to pay off their debt in affordable monthly payments over a period of three to five years, as determined by the court depending on monthly income, expenses, and assets. &lt;br /&gt;&lt;br /&gt;A Chapter 13 is also referred to as the “Wage Earners” bankruptcy because a debtor must be able to make a reasonable payment on their repayment plan, and stay current on their ordinary monthly payments.  However, as long as the debtor remains on the repayment plan and does not default, the foreclosure proceeding will be permanently terminated, and the debtor will come out of the bankruptcy with just their monthly mortgage payments.&lt;br /&gt;&lt;br /&gt;Bankrupty is a very serious step, with enduring consequences, but can provide debtors relief from the foreclosure process. When combined with a loan modification, predatory lending violations provide leverage to homeowners in their negotiations with the lenders as well.&lt;br /&gt;&lt;br /&gt;Finally, if a person is finding it difficult to make monthly mortgage payments because he or she is drowning in additional debt, and he or she may not even be able to make a modified payment amount, bankruptcy may be the best option.
